Responsibilities
BlueNet, via the Vacances-Location.net website and those of its partners, is the publisher hosting classified ads from advertisers, and visited by holidaymakers.
The publisher hosts, indexes, and automatically organises classified ads as an on-line service publisher.
Advertisers are the owners, the persons in charge or the managers of the holiday rental accommodations presented in the advertisings.
Holidaymakers are the persons seeking for a rental accommodation, usually for holidays, and who consult classified ads.
The content of each classified advert is solely the responsibility of advertisers and is not guaranteed by the publisher, who cannot be held responsible for the accuracy and reliability of such content. Published information of each advertising is not contractual and some data might be imprecise: it is absolutely necessary to establish a detailed rental agreement for each rental between advertisers and holidaymakers.
The publisher is not a party to any transaction entered into between holidaymakers and advertisers and therefore cannot be held responsible in case of dispute or disagreement. The publisher is not responsible for any negotiations and transactions between advertisers and holidaymakers. Advertisers and holidaymakers must take all necessary precaution during booking (the following examples are not exhaustive: rental agreement in due form, identity verification, etc.).
Advertisers are solely responsible for conducting their own investigations regarding any claim made by a holidaymaker. Holidaymakers are solely responsible for conducting their own investigations regarding any claim made by an advertiser.
Holidaymakers are solely responsible for the remarks written in the comments published in the listings. Advertisers are solely responsible for the remarks written as a response to the comments published in the listings.
The publisher assumes no liability whatsoever in case of any failure in performance of its obligations if due to any cause beyond the Publishers reasonable control, including server, internet network breakdowns etc. (telephone, or power failure, etc.) or cases of force majeure (war, strike, etc.). Advertisers and holidaymakers agree to an unavailability rate of a maximum of 10% for each service, in order to allow the publisher to perform the maintenance activities required for services. Regardless of the dysfunction or the duration of the unavailability of the service, the publisher will not pay any fee exceeding the cost paid for such service.
By using or continuing to use Vacances-Location.net and its partners, you acknowledge that you agree to the Terms and Conditions and assume all responsibilities.
Subscription to Services
Services for advertisers
The publisher commits himself to the largest publication possible, insofar as it is within his abilities, for the classified ads he is given. The publisher does not guarantee neither the results nor the consequences of the publication of the classified adverts.
If advertisers want to remove their advert permanently, they can do so via their account. The reactivation of the advert is possible and subject to a new subscription starting from the current date.
The publisher can, at any time and without prior notice, modify rates and special offers related to the publication of the adverts. Advertisers who already subscribed to an offer will not be affected by the change of rate. Free offers are not renewable, and are only available if the order is placed within 3 days after the subscription. Billing rates fully correspond to the activation fees (related to subscribed services).
The sites called "partners" are sites which allow to complete the service offered by Vacances-Location.net. They can be either managed by BlueNet or they can be a part of an independent structure. These partners publish or promote, fully or partially, the classified advertisements published on Vacances-Location.net under the present Terms and Conditions. In case of specialized partners, only the adverts corresponding to the partners theme are selected. The list of partners is given for reference only and can be modified, extended, or limited without prior notice.
Advertisers have a period of withdrawal of 7 days starting from the validation of their order. However, if the publication of the advert has already started, as requested by the client in the Order Form, reimbursement will not be accepted since the service will be considered as already started.
The publisher reserves the right to remove any advert or to suspend/terminate any advertiser account if one or several complains have been made or if he suspects a potential risk for holidaymakers. In that capacity, the publisher can be brought to ask documentary evidences to advertisers.
Advertisers have the option to activate or deactivate the "Comments" functionality in each of their listings. Advertisers have the option to publicly answer to each comment in their listing. Advertisers have the option to deny, on legitimate grounds (in case of libel, for example) the publication of a comment, by sending a written request to the publisher. The publisher reserves the right to deactivate any comment made by a holidaymaker and any eventual response from the advertiser.
Services for holidaymakers
Services offered to the holidaymakers are free and aim for a better search management.
The publisher reserves the right to restrict and terminate any holidaymaker account or the corresponding services if abuses are established. Abuses are characterised by an automatic, massive or inappropriate use of the services. Any use of the services provided for holidaymakers in connection with canvassing is expressly prohibited.
Holidaymakers can comment on the listings if the "Comments" functionality has been activated by the advertiser. The "Comments" functionality can be activated or deactivated at any time by the advertiser. Any publicity, spam, insulting or libellous messages, or messages unrelated to the advertising, are prohibited, including messages from holidaymakers who do not know the dwelling. Advertisers have the option to deny, on legitimate grounds (in case of libel, for example) the publication of a comment by sending a written request to the publisher. The publisher reserves the right to deactivate any comment made by a holidaymaker and any eventual response from the advertiser.
Confidentiality of Information
The publisher is committed to preserving the privacy of the users, whether advertisers, holidaymakers or occasional visitors. When a user registers as a holidaymaker or as an advertiser by filling out the subscription form, the publisher keeps the addresses and telephone numbers as well as the preferences that have been provided. This information allows the publisher to provide personalised services and to communicate more efficiently with the user. The publisher will contact the user, in particular by email, for the follow-up of the account and listings, to offer publications or optimisations, to present new services, or to inform about events or new features that might be of his/her interest.
The publisher can be brought to use this information to evaluate the preferences of the users and improve the services. The publisher does not share nor sell any data to other companies or agencies, except with his partners, in order to ensure the proper performance of the services.
Via email or regular mail, advertisers and holidaymakers can send a removal request for the entire information concerning themselves and their personal data. The removal will be performed within 7 days after reception of the request.
Advertisers Confidentiality of Information
In order to ensure the proper performance of the service, advertisers voluntarily authorise the publisher to publish the supplied information by creating the advert (Advert Creation or Advert Modification Form, including photos). The publisher fully assumes the consequences and the eventual use of the published information.
The adverts are removed from the publisher's catalogue at the end of the period stipulated during subscription. Nevertheless, they can remain accessible to the public after expiration via their direct URL, so they can be found by the users who have added it to their favourites. If advertisers want to eliminate this direct access, they can send a request via email or regular mail.
Holidaymakers Confidentiality of Information
In order to ensure the proper performance of the service, holidaymakers voluntarily authorise the publisher to publish his Selection of Properties once he/she uses the Share Functionality. The selection of properties includes the detail of the properties selected by the holidaymaker, as well as some identification data (name and initials of the surname, or user name). Holidaymakers shall assume the consequences and the eventual use of the published information.
In order to ensure the proper performance of the service, holidaymakers voluntarily authorise the publisher to communicate the information mentioned in the Contact Forms to the respective publishers. Holidaymakers assume liability of the eventual consequences and use of the information consequently provided to the publishers.
